Hungary and Portugal have high overstay rates under US visa waiver, says DHS report

Hungary and Portugal have high overstay rates over 2% under US visa waiver program, says 2016 DHS report.

Out of the total population, of the more than 21.6 million Visa Waiver Program (VWP) visitors expected to depart the United States in FY16, about 147,282 overstayed the terms of their admission, with 128,806 suspected in-country overstays (a .60 percent suspected in-country overstay rate for VWP travelers).

U.S. Code § 1187 – Visa waiver program for certain visitors, requires overstay rate for the country for the previous full fiscal year does not exceed the maximum visa overstay rate.

“Maximum Visa overstay rate” means, with respect to a country, the ratio of—

(I) the total number of nationals of that country who were admitted to the United States on the basis of a nonimmigrant visa whose periods of authorized stays ended during a fiscal year but who remained unlawfully in the United States beyond such periods; to

(II) the total number of nationals of that country who were admitted to the United States on the basis of a nonimmigrant visa during that fiscal year

According to Reuters, The threshold for the overstay rate triggering the public information campaign requirement is two percent, the officials said
