Grenada to provide Mutual Legal Assistance to Extradite Criminals with China

Grenada and China has signed extradition treaty which makes it easy for Grenada to extradite criminals applying for CBI passports under citizenship by investment programme

Prime Minister Dr. the Right Hon. Keith Mitchell said Grenada had debated new bill on mutual asssistance on the occasion of the 1st China Caribbean Conference on Anti-Corruption Law Enforcement Cooperation at Radisson Grenada Beach Resort. The new Act will be legal authority for giving legal assistance in criminal matters with China.

The bill, Extradition Treaty (Government of Grenada and the Government of The People’s Republic China) Bill, 2018 was passed in Parliament after being presented by Minister of Legal Affairs, Kindra Maturine-Stewart who described the treaty as a mutual arrangement between Grenada and the China.

In recent years, many of our Caribbean neighbours have worked with Beijing on a number of law enforcement issues, but there has not been a formal framework of cooperation. Sisters and brothers, it is our distinct hope that this conference will establish that framework.

For Grenada, we think it is particularly significant that this meeting is taking place only days after our parliament debated a new bill on Mutual Assistance. This will seek to incorporate into municipal law in Grenada, the Treaty on Mutual Legal Assistance in Criminal Matters between our Government and the Chinese Government. This treaty was originally signed in March 2016. Through this Act, the treaty will have the force of law in Grenada, providing legal authority for giving legal assistance in criminal matters.

H.E. XU Lingyi, Vice Chairman of National Commission of Supervision of People’s Republic of China at the China-Caribbean Conference on Anti-Corruption Law Enforcement Cooperation said..

In recent years, remarkable progress has been made in anti-corruption law enforcement cooperation between China and some Caribbean states. Thanks to your strong support and coordination, FU Yaobo, ZHANG Qingzhao and REN Biao, all of whom are “Red Notice” wanted, have been brought back to China.

The Treaty on Mutual Legal Assistance in Criminal Matters between China and Grenada, and the Extradition Treaty between China and Grenada have been signed and are undergoing review and approval by legislative bodies of the two countries.

China is also negotiating the signing of judicial and law enforcement treaties with other Caribbean states such as Dominica.

All governments should further improve domestic anti-corruption legal systems and coordination mechanisms. The designing of systems for entry and exit, immigration, and money-laundering should take into account the actual needs, so as to achieve zero loopholes in systems and mechanisms.

The New Today Grenada reported Minister of Foreign Affairs, Peter David pointed out that the Bill will compliment Grenada’s Citizenship by Investment (CBI).

“These issues arise sometimes with our CBI programme, there’s a lot of talk about CBI and persons who not above board. This legislation here is an indication that we are prepared to do everything to ensure that persons who come into Grenada, persons who transact business in Grenada, persons who become citizens of Grenada possibly under the CBI programme, if it is found that they have done something that is against the law of another country, in this case, China, we are prepared to deal with it…”, he said.

“…Only last year, Mr. President, Grenada cooperated with other Caribbean Countries in order to extradite persons, not from Grenada, in other countries, to China and the Chinese government was extremely pleased…and coming out of that…the person I spoke about last year…stole $100,000,000 in China and they were returned to China.
